Per a reputable lawyer that has been practicing for more than 35 years! This would be Fraud. It would be misdemeanor fraud if they cannot prove it was ongoing. To be a felony it would have to be over $500.00, However, many many stores do have cameras and security systems! You would be suprosed at how much a camera can actually see!

Fraud
Definition:
An intentional perversion of truth; deceitful practice or device resorted to with intent to deprive another of property or other right.


Misdemeanor
Definition:
A minor offense, lower than a felony, which is punishable by a county jail term of up to one year and/or a fine, but not prison. Misdemeanors are classified into three categories: Class A, B, and C.
